(1.2) ETERNA takes data protection very seriously and wishes to ensure that your privacy is protected during your use of their website. Hence, ETERNA has compiled these instructions for data processing to explain the handling of your data.

(1.3) ETERNA reserves the right to adapt the content of this Privacy Policy from time to time. We therefore recommend that you review this information on privacy at regular intervals.

 

§ 2       Personal data; duration of data storage

(2.1) Personal data shall mean any data containing information concerning the personal or material circumstances of an identified or identifiable customer. This includes, for example, your name, email address, residential address, gender or your phone number.

(2.2) ETERNA shall collect, process and use your personal data only with your consent or based on a provision of law. ETERNA will collect, process and use such personal data only to the extent that they are required for the performance or use of services or that you voluntarily make them available to ETERNA.

(2.3) Your personal data will be saved only for as long as is necessary for the provision of the services or performance of the contract. Under certain circumstances, the data may be saved beyond the above scope based on statutory or legal obligations.

 

§ 3       Cookies

(3.1) When using the ETERNA website, cookies will be saved on your computer. Cookies are small text files on your hard drive that are associated with the browser you are using and through which the party that sets the cookie (in this case ETERNA) obtains specific information. This technology helps us to optimise the offers on our website or of our online shop, e.g. by saving your personal preferences or your virtual shopping cart. The information collected does not permit the identification of a specific person and does not contain any data such as your name.

(3.2.1) Absolutely required cookies are essential and allow you to navigate the ETERNA website and use basic functions. Without these absolutely required cookies, the shopping cart, for example, cannot be made available to you.

(3.2.2) Functionality cookies ensure that information regarding your settings are saved (e.g. your language or region), which improves the personal functionality of the website for your benefit. These cookies also help to update or save your shopping cart.

(3.2.3) Performance cookies collect information on how you use the website, which pages you are visiting or, for example, if errors occurred. Such cookies help ETERNA optimise their website for you and make shopping easier and more pleasant.

(3.2.4) In addition, the ETERNA website also uses retargeting technology. This technology makes it possible to target internet users who have already shown an interest in ETERNA’s products and online shop through advertising on the websites of ETERNA’s (advertising) partners. This type of personalised and interest-based advertising is of greater interest for internet users than advertising without a personal connection. With the retargeting technology, promotional material is displayed on the websites of ETERNA’s (advertising) partners by means of a cookie-based analysis of previous user behaviour. No personal data are saved; the advertising is made through a pseudonym.

(3.2.5) Transient cookies will be deleted automatically when you close the browser. This includes session cookies in particular. This type of cookie saves a session ID, through which the various search requests of your browser can be assigned to your joint session. In this way, your computer will be recognised again when you return to the website. The session cookies will be deleted when you log out or close the browser.

(3.2.6) Persistent cookies will be deleted automatically after a specified period, which may differ depending on the cookie. The cookies set by ETERNA will be saved for a maximum period of 60 days. You can delete the cookies in the security settings of your browsers at any time.

(3.3) If you do not wish to use the cookies, you can block their use in your browser. However, ETERNA wishes to point out that this may impair the functionality of the website. § 4       Collection of personal data for information purposes

(4.1) If the website is used only for information purposes, in other words, if you do not log in or register for the use of the website, or otherwise transmit information to ETERNA, then ETERNA will not collect any personal data, with the exception of the data that your internet browser transmits to allow you to use the website. Thus, your internet browser transmits user data, which are saved in log files (server log files). The data sets saved in this connection contain the following data:

·      IP address

·      date and time of the query

·      time zone difference to Greenwich Mean Time (GMT)

·      content of the query (specific web page)

·      access status/HTTP status code

·      data volume transmitted in each case

·      website from which query originates

·      browser

·      operating system and its interface

·      language and version of the browser software

·      terminal device.

These log file data are evaluated anonymously for statistical purposes, to optimise the website, as well as offers from ETERNA. After their analysis, the data will be deleted.

(4.2) Reference is made to § 3.

 

§ 5       Collection, processing and use of personal data

(5.1) In addition to the use of the ETERNA website merely for information purposes (cf. § 4), ETERNA offers various services that may be of interest to you. To this end, you have to state as a rule additional personal data that ETERNA uses to provide the various services. If it is possible to enter additional voluntary data, such data will be marked accordingly.

(5.2) When contacting ETERNA by email or through the contact form, your email address and if you so state, your name and telephone number, will be saved by ETERNA to respond to your questions.

 

(5.3)    Use of the ETERNA online shop

(5.3.1) If you would like to order something from the ETERNA online shop, you have the choice of having the data required to process the order saved only once for this order (guest order) or creating a customer account in which your data will be saved for further purchases. For your order, ETERNA requires your correct name (first name and surname), your address data (invoice or different delivery address) as well as your desired payment method. Your date of birth is required to verify that you are of legal age. Since ETERNA will send you a confirmation of receipt or an order confirmation by email, you also have to state your email address.

 

Guest orders

Orders can be placed through the ETERNA online shop without a customer account. The required data for the processing of the purchase are marked accordingly; all other information is voluntary.

 

Orders with a customer account ('My ETERNA')

You may set up a password-protected customer account ('My ETERNA') by registering, in which case the data you provide there are saved, with the possibility of revoking them. After you have logged in with your access data, the information that must be entered in the order form will be populated automatically with the information provided by you. In the customer account, you can view the data of your completed, outstanding or recently shipped orders and correct/manage the data provided by you as part of the registration. You may delete the account in the customer section at any time.

 

(5.3.2) ETERNA will collect, process and use the data provided by you for your enquiries, the entire processing of the purchase including any later warranty claims on your part and for technical administration purposes. Your personal data will be passed to third parties or otherwise transmitted if this is necessary for the processing of the contract or for billing, or if you have previously consented. As part of the order processing, the service providers used by ETERNA (especially suppliers or transport companies) shall receive the data required for the processing of the order and contract. The data thus transmitted may be used by ETERNA’s service providers only for the purpose of performing their assignment. Any other use of the information is not permitted and shall not take place at any service provider commissioned by ETERNA.

(5.3.3) To prevent unauthorised access to your personal data by third parties, especially financial data, the order process will be encrypted by means of SSL (secure socket layer) technology.

 

(5.4)    Credit report

(5.4.1) ETERNA also offers 'Invoice' as a payment option. If you select this payment option in the course of the order process, ETERNA will transmit certain personal data to a carefully selected service provider to check your creditworthiness. In this way, ETERNA prevents the potential occurrence of bad debts or abuse related to a 'credit purchase'.

(5.4.2) If the 'Invoice' payment option has been selected, ETERNA will have a credit check carried out, based on mathematical and statistical methods, by the credit rating agency, CEG Consumer Reporting GmbH, Hellersbergstraße 11, 41460 Neuss, in order to safeguard its legitimate interests. To this end, ETERNA will transmit the personal data required to carry out a credit check (name, date of birth, address) to the above service provider. Based on this information, a statistical likelihood of a loss of the receivable will be calculated, and the decision on the further performance of the contract will be taken based on this assessment. The credit report can include probability values ​​(scores), which are calculated based on scientifically recognised mathematical and statistical methods. Other address information may also be taken into consideration in the calculations. Your interests will be taken into account in accordance with legal requirements.

(5.4.3) You may object at any time to the transmission of your data to the above mentioned credit rating agency by notice to ETERNA under the contact data specified in (10.1).) However, ETERNA wishes to point out that in the event of such objection the 'Invoice' payment option will not be available.

 

(5.5)    Product recommendations for similar ETERNA products

(5.5.1) In addition to the performance of the contract, ETERNA will use the email address provided by you in connection with your purchase of products to inform you regularly by email about similar products from ETERNA. This will be done irrespective of whether you have registered for the newsletter or not.

(5.5.2) You can object at any time to the use of your email for the sending of product information by notice to ETERNA without incurring any transmission costs other than those according to the base rates. You can notify your objection by clicking on the link provided in each product information email, by email to [email protected] or by a notice (e.g. by fax or letter) to the ETERNA contact details specified in (10.1). Your data will not be disclosed to third parties.

 

(5.6)    Newsletter

(5.6.1) You have the option of subscribing to our free ETERNA newsletter. To sign up for the newsletter, ETERNA uses the 'double opt-in' procedure. This means that ETERNA will send you a confirmation email after you have entered your email address in which ETERNA will request that you confirm your request to receive the newsletter. In this way, we can ensure that no third party has used your data. If you confirm your request to receive the newsletter, ETERNA will save your email address until you unsubscribe. The data are saved solely in order to send you the newsletter. In addition, ETERNA will save your IP address and the times at both registration and confirmation in order to avoid abuse of your personal information.

(5.6.2) The only required information for sending the newsletter is your email address. Any other information, marked differently, is provided voluntarily and is used only to personalise the newsletter. These data, too, will be deleted entirely upon revocation.

(5.6.3) You may revoke your consent to the dispatch of the newsletter at any time with effect for the future. You can notify your objection by clicking on the link provided in each newsletter email ('unsubscribe'), by email to [email protected] or by a notice (e.g. by fax or letter) to the ETERNA contact details specified in (10.1). Your data will not be disclosed to third parties.

 

(5.7)    Participation in prize draws, promotional competitions and other activities

 

(5.7.1) ETERNA organises prize draws, promotional competitions and other activities at irregular intervals. If you have to enter personal data to take part in such activities (e.g. your name, address or email address), ETERNA will use those data only to carry out the prize draw, promotional competition or other activity. For further details, please see the special terms and conditions for participation.

(5.7.2) If the prize draw, promotional competition or other activity is organised by ETERNA in collaboration with a third-party supplier, ETERNA is authorised to disclose your personal data to third parties. In this case, you will be informed about the disclosure of your data prior to the transmission of the data to third parties.

(5.7.3) If you have expressly so agreed as part of the participation in the prize draw, promotional competition or other activity, ETERNA will use - as explained in (5.6) - the email provided by you for the transmission of the free ETERNA newsletter. Your consent is voluntary. Failure to consent to the receipt of the newsletter or subsequent revocation of the consent will not have any negative impact on your chances of winning or your participation in the prize draw, promotional competition or other activity. You can revoke your consent to receive the newsletter at any time. § 6       Use of web analysis tools; web tracking

(6.1)    Use of Google Analytics

(6.1.1) This website uses Google Analytics, a web analysis service provided by Google, Inc. ("Google"). Google Analytics uses 'cookies', text files that are stored on your computer to help analyse your use of the website. The information generated by the cookies about your use of this website is normally transferred to a Google server in the USA and stored there. In case of activation of the IP anonymisation function on this website, your IP address will be truncated by Google within the Member States of the European Union or other parties to the Agreement on the European Economic Area. Only in exceptional cases will the full IP address be transferred to a Google server in the USA and truncated there. IP anonymisation is active on this website. On behalf of the operator of this website, Google will use this information for the purpose of evaluating your use of the website, for compiling reports on website activity, and for providing other services regarding website activity and internet usage to the website operator.

(6.1.2) Google will not link the IP address transferred by your browser as part of Google Analytics with any other data held by Google.

(6.1.3) You can prevent the saving of cookies by selecting the appropriate settings on your browser; however, ETERNA should like to point out that if you do this, you may not be able to access all the functions provided on this website.

(6.1.4) Furthermore, you can prevent the collection of data generated by the cookie and related to the usage of the website (including your IP address) and the processing of this data by Google by downloading and installing the browser plugin available at the following link: http://tools.google.com/dlpage/gaoptout?hl=de.3.

(6.1.5) This website uses Google Analytics with the extension '_anonymizeIp()'. This means that IP addresses will be abbreviated before processing; hence the data cannot be linked directly to a person.

 

(6.2)    Use of Webtrekk

(6.2.1) ETERNA uses the technology of Webtrekk GmbH, Robert-Koch-Platz 4, 10115 Berlin ('Webtrekk'). For further information about this third-party provider, please see https://www.webtrekk.com.

(6.2.2) The Webtrekkservices serve to collect statistical data about the use of the ETERNA online content to optimise such content for your benefit. Webtrekk is certified by the technical inspection agency TÜV Saarland for the field of data protection as part of web controlling software. Part of the certification is an audit at Webtrekk on site in Berlin and at the hosting location, in the course of which the collection and processing of tracking data is verified in regard to compliance with requirements in the field of data protection and data security.

(6.2.3) As part of the use of this website, information transmitted by your browser will be collected and analysed. This is done by means of cookie technology and 'pixels', which are included in each website. Cookies are small text files saved by the browser of an internet user on the latter's hard drive when the user visits a website. Most Webtrekk cookies are 'session cookies'. Those cookies do not damage the website of internet users and do not contain viruses. Those data cannot be associated with individual users.

 

Webtrekk uses the following cookies:

·      abbreviated IP address for geographic analyses down to city level

·      timestamp

·      clicks

·      E-commerce information, such as order value, products, quantity, etc.

·      content of forms: free text fields, such as name, email address, account number and telephone number are recorded as 'completed' or 'empty'. The input itself is not recorded.

 

With each request, the IP address is transmitted, to allow the server to transmit its responses. An internet address is assigned to each internet user by an internet provider (ISP), as soon as the user accesses the internet. The ISP knows which IP addresses were used when and by which internet user. The ISP is required by law to save this information.

 

Webtrekk does not save any IP addresses. Webtrekk immediately abbreviates the IP address in their tool for the purposes of session identification and geographic analysis. Webtrekk then deletes the IP address. It is not possible to link the Webtrekk data to individuals or to identify individuals through the Webtrekk data.

 

(6.2.4) You can object to the collection and saving of the data by Webtrekk at any time and with effect for the future. For this purpose, please use the following link: https://www.webtrekk.com/de/index/opt-out-webtrekk. By clicking the link, a cookie with the name of 'WebtrekkOptOut' will be saved by the Webtrekk web controlling on your computer to implement the opt-out. Your objection remains effective for as long as you don't delete this cookie; alternatively, the cookie becomes ineffective after a period of five years. Please note that by deleting all cookies on your computer, you will also delete this opt-out cookie. § 7       Request for customer review by eKomi

(7.1) For the purposes of customer reviews and product reviews by ETERNA customers, as well as for internal quality management purposes, ETERNA uses review software by eKomi Ltd., Markgrafenstraße 11, 10969 Berlin ('eKomi'), on its website. With this software, ETERNA wishes to provide you with the opportunity to submit a review after your purchase. eKomi is a company specialising in the web-based collection of authentic customer opinions, product reviews and recommendations. For further information about this third-party provider, please see http://www.ekomi.de.

(7.2) After dispatch of the goods, eKomi will send you a link to a purchase review web page, coupled with a request by ETERNA to submit a review of your purchase ('customer review request'). The submission of such a customer review on your part is absolutely voluntary.

(7.3) Since only customers who have purchased goods from ETERNA are able to submit a purchase review, it is indispensable that ETERNA transmits personal data communicated by you or order data to eKomi (your name, email address, the order number and article number). ETERNA discloses such data to eKomi solely for the purposes of collecting the customer review.

(7.4) You can object to the transmission of such a request for a customer review. You can notify your objection by sending an email to [email protected] or by a notice (e.g. by fax or letter) to the ETERNA contact data specified in (10.1).

 

§ 8     Use of the Facebook Social Plugin

(8.1) ETERNA currently uses the Social Plugin of the Facebook social network. Facebook is operated by the US company Facebook Inc., 1601 S California Ave, Palo Alto, California 94304, USA. For an overview of the Facebook plugins, please see: http://developers.facebook.com/docs/plugins/.

(8.2) If you visit a website that contains such a plugin, your browser is able to establish a direct connection with the Facebook servers and transmit data about your user behaviour to the Facebook servers (e.g. even if you do not click on the 'Like' button). By integrating the plugin, Facebook receives the information that your browser has accessed the corresponding page of our website, even if you don't have a Facebook account or are currently not logged into Facebook. This information (including your IP address) is transmitted from your browser directly to a Facebook server in the USA and saved there. If you are logged into Facebook, Facebook can assign the visit on the ETERNA website to your Facebook account. If you interact with the plugin, for example, by clicking the 'Like' button or submitting a comment, this information will also be transmitted directly to a Facebook server and saved there. § 9       Data security

ETERNA has created technical and organisational security measures to protect your data, in particular against loss, manipulation or unauthorised access. ETERNA regularly adjusts its security arrangements to ongoing technical developments.

Under the German Telemedia Act, ETERNA is obliged to keep the contents of declarations of consent available for retrieval at any time. You may revoke your declaration(s) of consent with future effect at any time. (11.1) Registration/creation of a customer account ('ETERNA')

By clicking on the 'Complete registration' button, you create a customer account with ETERNA ('My ETERNA') and thus agree to the saving of your data provided as part of the registration in the ETERNA customer database.
